Terms & Conditions

By accessing and using Rystella's services, you accept and agree to be bound by the terms and provision of this agreement. These Terms of Service constitute a legally binding agreement between you and Rystella. If you do not agree to abide by the above, please do not use our services. We reserve the right to change these terms at any time. Your continued use of our services following any changes indicates your acceptance of the new terms.

Rystella provides Shopify store development services, including but not limited to: • Custom Shopify theme development and customization • E-commerce website design and development • Store setup and configuration • Analytics integration and optimization • Ongoing maintenance and support services We reserve the right to modify, suspend, or discontinue any part of our services at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of our services.

As a user of our services, you agree to: • Provide accurate, current, and complete information • Maintain the security of your account credentials • Use our services only for lawful purposes • Not interfere with or disrupt our services or servers • Not attempt to gain unauthorized access to any part of our services • Comply with all applicable laws and regulations You are responsible for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account or any other breach of security.

Payment terms are established in your service agreement or project contract. Generally: • Payment is due according to the schedule outlined in your agreement • Late payments may incur additional fees as specified in your contract • All fees are non-refundable unless otherwise stated • We reserve the right to suspend services for non-payment • Disputed charges must be reported within 30 days Prices are subject to change with 30 days' notice. You will be notified of any price changes affecting your services.

Upon full payment for custom development work, you own the final deliverables created specifically for your project. However: • Rystella retains ownership of any pre-existing intellectual property • We may use general knowledge and techniques learned during your project • Third-party components may have their own licensing terms • We reserve the right to showcase your project in our portfolio (with permission) You grant us permission to use your business name and project details for marketing purposes unless otherwise agreed in writing.

To the maximum extent permitted by law, Rystella shall not be liable for: • Any indirect, incidental, or consequential damages • Loss of profits, data, or business opportunities • Damages resulting from third-party services or integrations • Issues arising from modifications made by other parties Our total liability for any claim shall not exceed the amount paid by you for the specific service giving rise to the claim in the 12 months preceding the claim.

We provide our services "as is" and make no warranties, express or implied, including: • Warranties of merchantability or fitness for a particular purpose • That our services will be uninterrupted or error-free • That defects will be corrected immediately We do warrant that: • Services will be performed with reasonable skill and care • Work will conform to specifications agreed upon in writing • We will use industry-standard security practices Any warranties are limited to the terms specified in your service agreement.

Either party may terminate services: • With 30 days' written notice for ongoing services • Immediately for material breach of these terms • Immediately if payment is overdue by more than 30 days Upon termination: • You remain liable for all charges incurred up to the termination date • We will provide reasonable assistance in transferring your data • Confidentiality obligations survive termination • You must cease using any proprietary materials or tools provided by us Termination does not release either party from obligations that accrued prior to termination.
